Bitcoin for an apartment by the sea - Is it possible to buy real estate with cryptocurrencies in Montenegro?

- There are real estate agencies in Montenegro, especially in coastal cities like Budva and Tivat, which offer the possibility of paying for real estate with cryptocurrencies, including Bitcoin and Ethereum. Also, some luxury resorts promoted this option with the aim of attracting foreign investors. Although there are reports on realized sales, they cannot be submitted to other persons for review, so specific examples are not widely documented. However, according to some unofficial information, by the end of 2024, three notarial records on the purchase and sale of cryptocurrencies have been drawn up - Radoš Kuč, founder of the Digitron Accounting agency, said in an interview for eKapija.
How does it all work? Kuč states that Montenegro still does not have a regulated law on crypto-assets, and since it is not included in the Government`s plans for 2025, it is expected to be adopted next year.
- When it comes to the purchase of real estate with cryptocurrencies, such trade exists, although it is not legally regulated. The value in the sales contract is expressed in fiat currencies, i.e. in euros, which is indicated in the contract. Transactions are usually completed before notarization and are carried out through digital wallets, since there is no exchange office for cryptocurrencies in Montenegro. Therefore, the conversion is most often carried out via foreign platforms - says Kuch.
As he explains, the purchase and sale contract for real estate must be expressed in euros, as it is the official currency of Montenegro.
- Cryptocurrency payments are usually made before the contract is verified, through a blockchain transaction, which can be verified within minutes. The seller confirms the receipt of the funds, and the notary relies on this confirmation in order to issue a clausula intabulandi, by which the seller expresses his consent for the buyer to be registered as the owner - Kuč states.
When asked whether foreigners can even bring cryptocurrencies into the country and use them to finance the purchase of real estate, our interlocutor answers in the affirmative.
- Foreigners can bring cryptocurrencies into Montenegro and use them to buy real estate under the same conditions as domestic citizens, but, as I already mentioned, the legal regulation does not exist, which creates legal uncertainty and a lot of ambiguity. There was a similar situation in the region, for example in Serbia, before the adoption of the law. That is exactly why I focused on this area and started cooperation with Miloš Praštal, the first crypto accountant from Serbia. Our plan is first of all education, and when the law is adopted, specialization for that area in Montenegro - says Kuč.
We were also interested in how real estate tax is paid. Kuč clarifies that from January 1, 2024, Montenegro applies a progressive tax on the sale of real estate, according to the following rates
- Up to EUR 150,000.00 3%;
- From EUR 150,000.01: EUR 4,500.00 + 5% on the amount over EUR 150,000.01;
- From EUR 500,000.01: EUR 22,000.00 + 6% on the amount over EUR 500,000.01.
- The tax is paid exclusively in euros, regardless of whether the payment was made in cryptocurrencies. The tax liability is reported to the Tax Administration, and in most cases, the notary submits the tax return on behalf of the party when certifying the contract. It is important to note that VAT is additionally payable for new construction. It is also the duty of notaries to submit contracts on the purchase and sale of cryptocurrencies to the Police Directorate and the Department for Financial Intelligence (FIU) - says Kuč.
When it comes to capital gain, says Kuč, in theory, it arises when a natural person sells assets (which can also be cryptocurrencies) at a price higher than the purchase value.
- The rate of tax on capital gains is 15%, and natural persons are required to submit an annual tax return no later than March 31 of the current year for profits realized in the previous year. This process can be complex due to the volatility of cryptocurrencies and the need to prove the purchase price, which requires keeping a record of transactions, he says.
And do banks allow funds from cryptocurrencies to be converted and deposited into the seller`s account before the sale? The interlocutor of eKapija says that banks in Montenegro do not support direct transactions with cryptocurrencies due to the lack of regulation and strict rules, which to some extent led to the withdrawal of one regional crypto-exchange from the Montenegrin market.
- That is why today in Montenegro there are no regulated crypto-exchanges or payment providers mediating these transactions. However, funds from cryptocurrencies can be converted into euros via foreign platforms and paid into the seller`s account, but banks often require proof of the origin of the money, which can complicate the process - says Kuč.
When asked about the risks when it comes to buying real estate in cryptocurrencies, Kuč explains that it is more of a legal issue, which he would not give an answer to.
- Precisely for this reason, our first goal is an education where, in addition to crypto accountants, lawyers with experience in this field would also participate - concludes Kuč in an interview with eKapija.
They sell apartments, houses, lots and cars for cryptocurrencies
As BIRN recently wrote, apartments, houses, lots and cars can be bought for cryptocurrencies on the Facebook ad space and numerous websites for the sale of vehicles and real estate in Montenegro. Cryptocurrencies can be used to pay for real estate in the luxury complexes of the company Dukley gardens and Dukley residence in Budva since December 2017. That company did not disclose how many properties in luxury complexes were purchased with digital money.
BIRN research from December 2023 showed that real estate in Montenegro is most often bought by citizens of Russia, Ukraine, Cyprus, the United Arab Emirates, Israel, and the United States.
- The best locations for buying real estate with cryptocurrencies are Budva, Kotor, Bar, Herceg Novi and Ulcinj - it is stated on the website of one of the real estate agencies that offers the possibility of buying with cryptocurrencies.
In September last year, the Ministry of Finance announced that, in cooperation with the Central Bank and the Capital Market Commission, they are working on a law that would regulate the field of digital assets.
