New public procurement rules from 2026 – “Green” criteria expanded

The Public Procurement Office has adopted a new Rulebook that expands and specifies the obligation to apply environmental aspects in public procurement procedures, which will enter into force on January 1, 2026.

According to the new rulebook, contracting authorities will have to apply environmental aspects in the technical specifications, criteria for the selection of bidders, conditions for the award of contracts or in the conditions for the performance of contracts when purchasing certain goods and services.

The obligation applies to photocopy paper, computer and office electronic equipment, air conditioners, cleaning products and services, as well as electrical household appliances, including washing machines and dryers, dishwashers, refrigerators and freezers.

The rulebook stipulates that at least 10% of the total volume of public procurement for the above types of goods and services must contain environmental aspects, which is an obligation for all contracting authorities.

At the same time, with the entry into force of the new regulation, the previous Regulation from 2023, which covered a narrower range of goods, ceases to be valid.
