How to get certificates from police and court to participate in tenders?

New Law on Public Procurements, which aims to ensure full legality and disable corruption, calls for procedures that make it necessary for the directors of public companies to acquire appropriate certificates from the police, the First Basic Court and the Court of Commerce for every tender in which they want to partake.

The director of a company that intends to participate in a tender must, for example, obtain a certificate from the police that he or she is not being prosecuted, which usually takes about ten days to complete.

Such certificate, however, cannot have the issue date older than the tender announcement date.

The same applies to certificates obtained from courts.

The First Basic Court issues a certificate based on which it can be concluded whether the responsible person is under prosecution, whereas the Court of Commerce's certificate specifies if the director had been charged with a criminal offence prior to the issue date of that document.

Ivana Ramic, the spokesperson of the First Basic Court, says to Tanjug news agency that the procedure for getting aforementioned certificate is very simple and can take only five minutes if the person comes directly to the court.

Ramic also explains that the same certificate can be obtained from the First Basic Court on the basis of an electronic request, claiming that this procedure too is accelerated.
