Bar Association of Serbia makes new decision – Three-day cessation of activities

After the Higher Court in Belgrade annulled the decision of the Assembly of the Bar Association of Serbia on a seven-day cessation of activities, the Managing Board of the Bar Association of Serbia made a new decision on a three-day cessation of activities, which lasts from today until Thursday, January 23.

The explanation points out that the Managing Board of the Bar Association of Serbia made that decision as a forced reaction to the decision of the Higher Court in Belgrade by which the previous decision on the cessation of lawyers’ activities is annulled, saying that the formulation of that decision by the Higher Court “is unclear, contradictory, not in accordance with the explanation, and the decision itself is completely unlawful.”

– We especially emphasize that, by this decision, the Managing Board of the Bar Association of Serbia provides full and unconditional support to the decision of the Assembly of the Bar Association of Serbia which was adopted at the session held on January 18 and that, with this decision, essentially, the decision of the Assembly of the Bar Association of Serbia as the highest organ of the Serbian legal profession is consistently implemented – it is emphasized in the announcement.

As pointed out in the decision, during the cessation of activities, lawyers will neither enter nor stay on the premises of courts, prosecutors’ offices, the police, government bodies, public enforcement officers and public notaries under any professional basis. Lawyers will only file to courts, prosecutors’ offices and bodies those submissions which are related to the occurrence of preclusive deadlines.

– The operations of lawyers in accordance with paragraph three of this decision are the defined minimum work processes necessary for the protection of the clients’ basic rights and interests – the decision adds.

The Bar Association of Serbia calls on all authorities to honor the constitutional principle of the division of power and act within their competence and emphasizes that the legal profession is an independent service of providing legal help, as also proscribed by the Constitution of Serbia.

– The Bar Association of Serbia calls for honoring the Constitution and laws of the Republic of Serbia in the interest of all citizens – the decision says.
