Association for Protection of Enterprises and Companies of Serbia Launches Constitutional Initiative for Cancellation of Eco-fee Decree

The Association for Protection of Enterprises and Companies of Serbia (Udruzenje “Zastitnik preduzetnika i privrednika Srbije”) has filed an initiative for the cancellation of the decree on the eco-fee to the Constitutional Court, because, as they say, they believe that the decree, in its current form, is an instrument for the implementation of a parafiscal charge which burdens the taxpayers in an uneven fashion, whereby “its implementation into the tax system is justified with the noble cause of environmental protection”.

– In the time of the biggest crisis, enterprises, companies and associations are burdened with another parafiscal charge in the form of the Decree on the Criteria for Determining the Activities Affecting the Environment by the Degree of Negative Impact on the Environment Arising from the Activities (Official Gazette of the Republic of Serbia no. 86/2019 and 89/2019), the so-called eco-fee. We demand for the eco-fee in its current form to be removed – the association says.

They add that each future charge pertaining to ecology should be harmonized with all the other laws and that an independent control body consisting of representatives of environmental organizations should be assembled for the purpose of controlling whether the funds are spent exclusively for the purpose, because it isn't the case at the moment.
