Solidary responsibility for illegal construction to be implemented – Investors, land owners and contractors to be subject to criminal charges

Serbian Deputy Prime Minister and Minister of Construction Zorana Mihajlovic announced this Thursday that, to the end of preventing illegal construction, the institution of solidary responsibility would be implemented, covering investors, land owners and contractors.

– We will amend certain rulebooks and implement the institution of solidary responsibility for illegal construction. This means that it is not only the investor that is responsible, but also the owner of the parcel and the contractor. All three are subject to criminal charges – Mihajlovic told the press.

She says that the inspection services work around the clock and that having construction works being carried out at night was no way to avoid the law.

– When the inspector closes the construction site and puts up the tape, any moving of the tape is a criminal activity and is followed by criminal charges against the investor by the inspector. Sometimes it’s not known who the investor is, but the owner of the land is easy to determine by looking up the land register – Mihajlovic said.

The minister also says that there have been many criminal charges due to illegal construction, as well as that the biggest problem is in Belgrade, because certain municipalities have allowed illegal buildings to be finished and apartments to be sold.

– Municipal inspection services have done a terrible job – she said.
