Notaries are soon returning to legal system of Serbia; the authorities are working on the sketches of the regulation for public notaries

The work group formed by the ministry of justice of Serbia is working on a regulation about public notaries which will help the foundation, organisation and authorisation of notaries in Serbia. They expect to have the sketch finished by the end of 2006.

This regulation will help the notary (or public notary) to finally become a separate justice profession, which Europe has for a long time, and which should find it's place in the legal system of Serbia.

Public notary is an intependent justice act. It is about those public confidence jobs, that is, about those jobs which the state has to check - that means that the notaries have the same legal strength as any other governmental agency - the court or administrative organs.

For example, the court has to certify a signature in the present legal system in Serbia, which is an unneccessery load for it. If a notary would certify the documents and signatures, the system would be much more efficiant. The same goes for the contracts about realestates and wills.
