Contractors for Construction of Tirsova 2 to Be Sought in Competitive Procedure with Negotiation – State Opens New Tender, Price Remains Same

The Ministry of Public Investment has opened a new tender for the construction of the University Children’s Clinic Tirsova 2, and this time, instead of an open procedure, contractors will be sought in a competitive procedure with negotiation.

The price of the tender has not been changed since the last time and is still RSD 11.2 billion (around EUR 95 million) without the VAT, and more details (in Serbian) about the tender can be found HERE.

Let us remind that it was precisely the price that was the reason for the cancellation of the previous tendering procedure, because the bid of the only interested group of bidders was higher by nearly RSD 4 billion without the VAT.

The only bid was submitted by the consortium of the companies SMB Gradnja, W.D. Concord West, Telegroup, MPP Jedinstvo ad Sevojno, A.R.J Technology, DBS, Elektrozapad, Ipon Sistem, Premer Savkovic and PP Inzenjering Stojanovic.

When can a competitive procedure with negotiation be carried out?

The Law on Public Procurement Procedures says that the public procuring entity may carry out a competitive procedure with negotiation for a public procurement of goods, services, or works in the cases when the needs of the public procuring entity cannot be satisfied without the adaptation of easily available solutions, when the contract entails planning or innovative solutions and when the contract cannot be awarded before prior negotiation due to the specific circumstances pertaining to the nature, complexity, legal, or financial structure of the subject of the public procurement procedure or the related risks.

Also, a competitive procedure with negotiation may be initiated when the public procuring entity cannot determine the technical specifications of the subject of the procurement with sufficient precision and when, in the previously carried out open or restrictive procedure, all the bids were unacceptable.
