New Labor Law by end-2021

The adoption of the new Labor Law is planned by the end of 2021. The forming of the working groups and the public discussion about the new law are planned for the upcoming year, said the Minister of Labor, Employment, Veteran and Social Policy of Serbia, Zoran Djordjevic.

The Chamber of Commerce of Serbia recently proposed amendments pertaining to sick leaves, and Djordjevic points out that this area is well regulated by the existing law.

– When it comes to this suggestion, I am inclined to take the side of the unions and the workers, as I believe that the current Labor Law defines in detail how sick leaves are used – the minister said.

He points out that Article 103 regulates how sick leaves are justified, whereas Article 170, Paragraph 3, Items 3 and 7 and Paragraph 4 define what amounts to the abuse of sick leaves and how it can be proved.

Next year as well, one of the priorities of the Ministry of Labor, Employment, Veteran and Social Policy will be the issuing of welfare cards, and minister Djordjevic says that the new Law on Employment Injury Insurance, which is being prepared, says that all employers need to insure their workers.

If the employer has not taken all measures to protect the worker in line with the law, the insurance company, in addition to the state, sues the employer, and the employee can also sue the employer for failing to provide adequate protection and safety at work.

– Another new feature is that sick leaves of up to 30 days are no longer taken at the expense of the employer, but the insurance, so if there is abuse, the insurance company sues the worker – Djordjevic added.
